When your current home was initially built you may have required a planning permit. Issued by your local council, a planning permit gives you permission to develop or use the land in a particular way and in accordance with the relevant building legislation. All proposed structural works to an existing building require a building permit. This ensures that buildings are constructed to comply with the Building Code of Australia and that your proposed works meet with the regulations and the necessary building legislation.
If you decide you want to change your already developed property in some way, you will need to obtain an amendment to the original planning permit. While amendments are available, it should be noted they aren’t always granted.
When it comes to assessing planning permits, there are many considerations that come into effect. Some of the factors that will be considered by council include:
- If there are any restrictions that may apply to the building site
- Is the proposal consistent with the purpose of the area where the land is?
- Is a certain portion of the property allocated to a garden?
- Does the proposal maintain or enhance the character of the neighbourhood?
- Is there ample car parking for the number of dwellings on the site?
These and many other factors will impact whether an amendment to your planning permit will be granted.
